Terms of Service, Warranty & Liability
1. Acceptance of Terms
By accessing this website or purchasing any product from ON Performance LLC (“ON Performance,” “Company,” “we,” or “us”), you agree to be bound by these Terms of Service (“Terms”). These Terms govern all purchases, use of products, and related services. If you do not agree to these Terms, do not proceed with purchase, installation, or use of any product.
2. Orders, Pricing & Availability
All products are subject to availability, and pricing may change without notice. ON Performance LLC reserves the right to refuse, limit, or cancel any order at its sole discretion, including but not limited to pricing errors, inventory discrepancies, or suspected misuse. If an order is canceled after payment, a refund of the purchase price will be issued.
3. Returns & Restocking
You may return eligible products within 30 days of delivery, provided the product is unused, uninstalled, and in original condition and packaging. All approved returns are subject to a 10% restocking fee after receipt and inspection. Shipping charges are non-refundable unless otherwise required by law. Products that have been installed, modified, damaged, contaminated, or returned incomplete may be refused or subject to additional fees.
4. Lifetime Limited Warranty
4.1 Warranty Coverage
ON Performance LLC warrants that its products are free from defects in materials and workmanship for the lifetime of the product, when used under normal operating conditions and installed in accordance with provided instructions and industry best practices.
This warranty applies only to manufacturing defects and does not guarantee product lifespan, performance level, or suitability for any specific application.
4.2 Exclusions – What Is Not Covered
This lifetime warranty does not cover:
Normal wear and tear, including but not limited to seals, bearings, brushes, filters, or consumable components
Damage caused by improper installation, wiring, tuning, or calibration
Misuse, abuse, negligence, racing abuse (unless explicitly stated otherwise), or operation outside stated specifications
Contamination (fuel, debris, moisture, corrosion), electrical faults, voltage irregularities, or inadequate filtration
Modifications, disassembly, or repairs performed by anyone other than ON Performance LLC
Cosmetic wear or non-functional changes
Determining whether a failure is the result of a defect or an excluded condition shall be at the sole discretion of ON Performance LLC.
4.3 Warranty Claims & Process
All warranty claims require proof of purchase and may require the product to be returned for inspection at the customer’s expense. ON Performance LLC reserves the right to deny warranty claims that do not meet the terms outlined herein.
4.4 Exclusive Remedy
The sole and exclusive remedy under this warranty is, at ON Performance LLC’s option:
Repair of the defective product
Replacement with the same or comparable product
Refund of the original purchase price
Labor costs, vehicle downtime, towing, diagnostics, removal/reinstallation, and all incidental or consequential damages are expressly excluded.
5. Legal Compliance, Product Use & Installation
5.1 Compliance with Laws
You are solely responsible for understanding and complying with all applicable local, state, and federal laws regarding vehicle modifications, emissions systems, safety standards, inspections, and road use. Any fines, penalties, failed inspections, or legal consequences resulting from product use are the sole responsibility of the purchaser and/or installer.
5.2 OEM Vehicle Warranty
ON Performance LLC is not responsible for any impact on a vehicle manufacturer’s warranty. It is your responsibility to understand how aftermarket parts may affect OEM coverage.
5.3 Safe Operation
ON Performance products may alter vehicle performance, emissions, noise, or drivability. Installation and use are undertaken at your own risk. ON Performance LLC is not liable for property damage, personal injury, death, or legal consequences resulting from unsafe operation or failure to comply with laws.
5.4 Assumption of Risk
By purchasing, installing, or using any ON Performance product, you knowingly assume all risks associated with performance automotive components, including legal, mechanical, and safety risks.
6. Disclaimer of Other Warranties
Except for the lifetime limited warranty expressly stated in Section 4, ON Performance LLC makes no other warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, durability, or performance. All products are provided “as is” and “as available,” to the fullest extent permitted by law.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ON PERFORMANCE LLC, its owners, employees, agents, affiliates, and suppliers shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages, including but not limited to:
Vehicle damage, fires, or property loss
Personal injury or death
Loss of use, downtime, or lost profits
Fines, penalties, or legal costs
arising from the purchase, installation, use, misuse, or failure of any product, regardless of legal theory.
8. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute arising from or related to these Terms or any purchase shall be resolved exclusively through binding arbitration in Chicago, Illinois, and not through court proceedings or class actions.
9. Entire Agreement
These Terms constitute the entire agreement between you and ON Performance LLC regarding purchases, warranties, liability, and risk allocation, and supersede all prior or contemporaneous agreements or representations.
10. Changes to Terms
ON Performance LLC reserves the right to modify these Terms at any time. Updated Terms will be posted on this website and shall apply to purchases made after the effective date.
